These Terms of Service ("Terms") form a binding agreement between you and CAPONES GAINESVILLE LLC ("Al Capone Downtown", "we", "us") governing your use of https://alcaponedowntown.com and our Services. By creating an account, purchasing a membership, or buying from the store, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old to create an account or make a purchase. You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.

2. Membership and subscriptions

Memberships are offered on a monthly plan at $9.99 and an annual plan at $99.99. New members may be offered a 30-day free trial. You will not be charged during the trial.

3. Auto-renewal and billing

In plain language: your membership renews automatically so your access never lapses. When your free trial ends, your chosen plan begins and your payment method is charged the then-current price. Monthly plans renew every month and annual plans renew every year, on the same date, until you cancel. We may notify you of upcoming charges and any price changes in advance.

4. How to cancel

You can cancel at any time from the Account page or by emailing info@alcaponedowntown.com. Cancellation stops future renewals. You keep access until the end of the current billing period, and free recipes remain free to you afterward. Refunds, where applicable, are handled under our Refund Policy.

5. Store purchases

Prices for store items are shown at checkout and may change. We aim to describe products accurately but do not warrant that descriptions are error-free. Risk of loss passes to you on delivery. Returns and refunds are governed by our Refund Policy.

6. Acceptable use

You agree not to copy, redistribute, scrape, or resell our recipes or content, attempt to gain unauthorized access to the Services, interfere with their operation, or use them for any unlawful purpose. Membership grants you a personal, non-transferable license to access content for your own use.

7. Intellectual property

All recipes, text, photography, logos, and other content on the Services are owned by CAPONES GAINESVILLE LLC or its licensors and are protected by intellectual property laws. Except for the limited access granted to members, no rights are transferred to you.

8. Disclaimers

The Services are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. Cooking involves heat, sharp tools, and allergens; you are responsible for safe practices in your own kitchen. See our Disclaimer for more.

9. Limitation of liability

To the fullest extent permitted by law, CAPONES GAINESVILLE LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, you agree to the exclusive jurisdiction of the state and federal courts located in Florida.

11. Arbitration and class action waiver

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered under the rules of a recognized arbitration body, rather than in court, except that either party may bring qualifying claims in small claims court. You and we agree that each may bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative action. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.

12. Changes to these Terms

We may update these Terms from time to time. We will post the revised version with a new date, and your continued use after changes take effect constitutes acceptance.
